Terms of Service

These Terms of Service ("Terms") govern your access to and use of Torch Talent (the "Service"), operated by Torch Talent ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Torch Talent is a job board that aggregates publicly available job postings and allows employers to publish their own listings. We do not employ candidates, and we are not a party to any employment relationship or application between users and employers.

2. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Accounts

Some features require an account. You are responsible for the information you provide, for activity that occurs under your account, and for keeping your credentials secure. You agree to provide accurate information and to keep it up to date.

4. Employer content and job postings

If you post content such as an organization profile or a job listing, you are solely responsible for it and represent that you have the right to publish it and that it is accurate and lawful. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content for the purpose of operating and promoting the Service. We may remove or decline to display any content at our discretion.

5. Acceptable use

You agree not to:

• Post false, misleading, discriminatory, or unlawful content;
• Scrape, copy, or harvest data from the Service except as expressly permitted;
• Interfere with or disrupt the Service or attempt to access it without authorization;
• Use the Service to send spam or to infringe the rights of others.

6. Third-party content and links

The Service includes job postings and links from third parties, and applications are often completed on third-party websites. We do not control and are not responsible for third-party content, sites, or practices. Your use of them is at your own risk and may be subject to their own terms.

7. Intellectual property

The Service, including its design, text, and branding (excluding user and third-party content), is owned by us and protected by applicable laws. You may not use our marks without our prior written permission.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that listings are accurate, current, or available, or that the Service will be uninterrupted or error-free. We do not guarantee any employment outcome.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your content, your use of the Service, or your violation of these Terms.

11. Changes

We may update these Terms from time to time. If we make material changes, we will update the date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict-of-laws principles.
